What Are the Standard Terms of an Independent Film Financing Deal?
The usual indie film finance deal first repays the investors with interest, then splits any additional "back end" profits from the film equally between the producer and the investor. If there is more than one investor, the investors share pro rata in the 50% "investors' share" of the profits. If the producer has promised "back end" participation to talent, the director or other participants, their share comes out of the "producer's share" of the profits. (That said, talent with a high marquis value can often negotiate getting their deferred fees paid out of the first monies received by the producer -- i.e. before the investors are repaid).
